Fartnet — Terms of Service

1. Acceptance

By creating an account or using Fartnet ("the Service") you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. By using it you confirm that you meet this minimum age. The Service contains crude humor and audio recordings of bodily-noise content; use it accordingly.

3. Accounts

The Service can be used anonymously. An anonymous account is created on first launch and is bound to the device. Optionally you can attach a nickname and password to enable cross-device login. Recovery codes are issued once at registration; you may also attach an email address for password recovery. Without your recovery codes or a verified email, a lost password cannot be reset.

You are responsible for keeping your credentials and recovery codes confidential. We are not liable for losses resulting from compromised credentials.

4. Content rules

You retain ownership of audio recordings and other content you publish. By publishing, you grant us a worldwide, non-exclusive, royalty-free license to host, store, transcode, distribute, display, and remove your content as needed to operate the Service.

5. Moderation

You can report content via the in-app report flow. We commit to reviewing reports of objectionable content within 24 hours and removing or quarantining content that violates these Terms.

6. Privacy

How we handle your data is described in our Privacy Policy. It forms part of these Terms.

7. Account termination

You may delete your account at any time inside the app: Me → Delete account permanently. This is irreversible: all your farts, comments, likes, and bookmarks are removed; your nickname becomes a tombstone and cannot be reused by you to recover the account. Audio originals retained for up to 30 days for abuse review are then permanently destroyed.

We may terminate your account for material breach of these Terms, illegal activity, or extended inactivity (24 months).

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that user-published content is accurate or lawful. Audio published by other users is their responsibility, not ours.

9. Limitation of liability

To the fullest extent permitted by law, in no event will Fartnet, its operators, contractors, or licensors be liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total cumulative liability for any claim is limited to EUR 50 or the amount you paid us in the past twelve months, whichever is greater. Some jurisdictions do not allow this limitation; in those cases the limitation applies to the maximum extent permitted.

10. Indemnification

You agree to indemnify, defend, and hold harmless Fartnet and its operators from any claim, demand, or damages, including reasonable legal fees, arising out of: (a) your use of the Service in violation of these Terms; (b) content you publish; (c) your violation of any third-party right.

11. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict-of-law rules. Disputes are subject to the exclusive jurisdiction of the courts of Novi Sad, Serbia, except where mandatory consumer-protection laws of your residence apply.

12. Changes

We may amend these Terms from time to time. The current version is always available at https://fartnet.app/terms-of-service/. Material changes are notified in-app at next launch. Continued use after a change is acceptance of the revised Terms.

14. Severability

If any provision is held unenforceable, the remaining provisions remain in full force.

15. Entire agreement

These Terms, together with the Privacy Policy and any feature-specific notices we may publish, constitute the entire agreement between you and us regarding the Service and supersede prior agreements.
